I – PIXSIDE GAMES – Introduction

II – USER REGISTRATION
In general, registration for USERS interested in acquiring PIXSIDE GAMES products is optional, except when a minimum age is required or depending on the payment method used for purchasing paid products.
If the USER chooses to register or if registration is required, the USER must provide the requested information, and is solely responsible for the accuracy of the provided data.
PIXSIDE GAMES reserves the right to use all valid and possible means to identify its USERS, as well as to request additional information and documents that may be considered necessary to verify the information provided by USERS.
If incorrect or false registration data is identified, or if the USER refuses to provide requested documents, PIXSIDE GAMES may block the USER's access, preventing them from viewing the available products, or temporarily suspend or permanently cancel the USER's registration, without prejudice to taking other necessary measures.
PIXSIDE GAMES may send information about website or game updates to the registered USERS' email. However, USERS can modify their preferences if they do not wish to receive such communications.
III – PIXSIDE GAMES PRODUCTS
PIXSIDE GAMES offers its USERS electronic games with educational content, providing useful information and new knowledge across various electronic platforms and social networks, including the website www.pixsidegames.com, which serves as the main support for promoting its products and offers.
The products available on PIXSIDE GAMES' website are the sole responsibility of PIXSIDE GAMES.
If a product offered by PIXSIDE GAMES matches the features and specifications disclosed on the PIXSIDE GAMES portal but does not work on the USER's server, the USER must ensure they are using an operating system compatible with the one developed by PIXSIDE GAMES, and PIXSIDE GAMES is not responsible for the functionality of the products offered.
To properly use the resources provided by PIXSIDE GAMES on its website, USERS must follow all terms, conditions, and instructions outlined in this Agreement. PIXSIDE GAMES is not responsible for any damages arising from non-compliance with these conditions.
PIXSIDE GAMES may, at any time, update, improve, add, or correct product features without prior notice.
PIXSIDE GAMES may hire third-party companies to help provide certain products to USERS. PIXSIDE GAMES may use third-party companies to process online transactions and credit card payments.
PIXSIDE GAMES does not authorize third-party companies to use or store USERS' personal information under any circumstances, except when necessary for the proper use of the products. The data will be transmitted securely and used only during the transaction process. PIXSIDE GAMES has measures in place to ensure third-party companies respect USERS' privacy.
IV – ACQUISITION OF PIXSIDE GAMES PRODUCTS
The acquisition of PIXSIDE GAMES products will occur through direct contact between a third-party company and USERS, in a secure online purchase environment.
For transactions, the disclosure of USERS' data will be required and will be treated with appropriate protection and confidentiality by PIXSIDE GAMES.
It is possible that products may be offered for free, at PIXSIDE GAMES' discretion, which may change at any time, without prejudice to acquisitions already made by USERS.
V – USER DATA
As mentioned above, PIXSIDE GAMES is concerned with the preservation of USERS' data and, like many other service and product sales websites, uses "cookies" and "pixel tags" to improve USERS' visits to the PIXSIDE GAMES website.

PIXSIDE GAMES may disclose aggregated USER information, such as demographic data, in statistical analyses to third parties for technical, analytical, logistical, or other functions/tasks on behalf of PIXSIDE GAMES. Aggregated information does not include personal data.
PIXSIDE GAMES' website may contain links to other websites. PIXSIDE GAMES has no control over the privacy practices or content of its commercial or content partners, sponsors, or other websites linked on its site. USERS should review the privacy policies of third-party websites once they click on links leading to those sites.
VII – USER DATA SECURITY
The security of USERS' personal information is of utmost importance to PIXSIDE GAMES, which will maintain physical, electronic, and procedural safeguards to ensure the integrity of USERS' personal data, including advanced encryption and authentication tools.
When USERS make a purchase, the entire transaction will occur in a secure, automated, electronic environment, without human contact. All credit card information will be transmitted via Secure Socket Layer (SSL) technology and then encrypted in PIXSIDE GAMES' database, so that it cannot be externally accessed, provided that such payment methods are available at PIXSIDE GAMES' discretion.

VIII – CONDITIONS FOR USING PRODUCTS
The use of products provided by PIXSIDE GAMES is not allowed for any illegal activity, and USERS are only permitted to use the products for lawful purposes.
USERS must not use the products provided by PIXSIDE GAMES in any manner that could damage, disable, overload, or harm the servers or networks, or interfere with the use and enjoyment of the products by other USERS. USERS must not attempt to gain unauthorized access to any of the products, other users' accounts, computer systems, or networks, through improper manipulation of passwords or any other analogous means of hacking and/or violation of computer security protocols.
USERS must use the products only in compliance with these terms and must observe applicable laws and regulations. The formatting, layout, appearance, source codes, executables, and all functionalities of the products, as well as all intellectual and industrial property associated with the portal and products, are the property of PIXSIDE GAMES, and may not be reproduced or used without authorization.
The USER must not, under penalty of legal liability, do the following:
a) Copy, modify, adapt, translate, or reverse engineer any part of the website, the products, their contents, or materials;
b) Violate any copyrights, trademarks, or other proprietary rights contained in or on the website, the products, or any content displayed;
c) Use any robot, spider, site search or retrieval application, or other automated devices, process, or means to access, retrieve, or index any part of the site or products;
d) Access, retrieve, or index any part of the site or products for the purpose of building or filling a searchable database of opinions related to PIXSIDE GAMES;
e) Reformat, edit, or build any part of the web pages that are part of the site or products;
f) Create user accounts by automated means or under false or fraudulent pretenses;
g) Create accounts that contain illegal, offensive, threatening, defamatory, pornographic, or obscene content;
h) Collect or store personal data of other USERS for any purposes;
i) Allow the use of their account by individuals who are not properly registered as USERS;
j) Use the portal or PIXSIDE GAMES products to store or transmit any illegal or offensive materials, nor store or transmit materials that violate the privacy rights of other USERS or third parties;
k) Use the portal or PIXSIDE GAMES products to store or transmit malicious code or software, including but not limited to viruses, trojans, hijackers, spywares, malwares, among others;
l) Attempt in any way to gain unauthorized access to the portal or the products of PIXSIDE GAMES or its related systems or networks.
PIXSIDE GAMES does not guarantee that: a) the product will be free of flaws or defects; b) the product will fully meet your needs; and c) any error detected in the product’s qualification will necessarily be corrected.
PIXSIDE GAMES is not responsible for inappropriate, illegal, or offensive content transmitted or inserted by its USERS while using PIXSIDE GAMES products.
IX – REMUNERATION
The products provided will be sold through the payment of a subscription fee, tariffs, and/or remuneration of any nature, depending on the product, which may, occasionally, be provided free of charge.
The actual payment will be made according to the terms outlined in section IV above.
X – TERMS
These terms will remain in effect indefinitely from the date of the USER's acceptance of these terms, as indicated in section I above.
The USER may terminate this contract at any time, without charge, by canceling their account via the website, if available; by requesting cancellation via email; or by simply uninstalling the PIXSIDE GAMES product from the device it was installed on.
PIXSIDE GAMES may immediately cancel the USER’s account, without prior notice or warning, terminating the contract by right, without prejudice to indemnification for any losses or damages, if the following is found:
a) Violation of any of the provisions in these terms;
b) A new registration by a USER whose account was canceled or suspended;
c) Duplicate registration of the USER;
d) Accounts containing illegal, offensive, threatening, defamatory, pornographic, or obscene content;
e) Fraud or attempted fraud by the USER;
f) Provision of incorrect and/or false information.
XI – LIMITATION OF LIABILITY
Neither party shall be liable for any consequential damages, lost profits, or moral damages arising from or related to these terms, whether contractual or non-contractual, objective or subjective.
XII – RESPONSIBILITY OF PIXSIDE GAMES
PIXSIDE GAMES is not responsible for the content published by third-party companies on its platform, but will make every effort to verify its accuracy.
PIXSIDE GAMES will not be liable for any direct, indirect, incidental, special, or consequential damages, including, but not limited to, consequential damages, lost profits, moral damages, or other intangible losses (even if it has been advised of the possibility of such damages), resulting from the use or inability to use the products provided by the online platform.
PIXSIDE GAMES will not be responsible for the misuse of USERS' names, their data, or access passwords and the consequences of such misuse, such as loss, theft, or damage of information.
The absence of responsibility from PIXSIDE GAMES does not affect any rights the USER may have to file a claim against third-party companies. All complaints, suggestions, or negotiations should be addressed directly with the third-party companies.
XIII – CONFIDENTIALITY
PIXSIDE GAMES guarantees the confidentiality of all information sent to it, committing not to use it outside the normal operation of its online platform.
The data provided by USERS will be processed by PIXSIDE GAMES, as the entity responsible for handling such data. PIXSIDE GAMES will communicate the necessary data for contact between the USER and third-party companies when the USER expresses an intention to purchase a specific product provided.
All content entered by the USER when registering their account is confidential and private. PIXSIDE GAMES has no ownership rights over the content entered by the USER into their account.
Confidential Information does not include any information that (i) is or becomes widely known to the public without violating any obligation owed to the disclosing Party, (ii) PIXSIDE GAMES knew before its disclosure by the USER, (iii) is received from a third party without violating any obligation owed to the USER, or (iv) is developed independently by PIXSIDE GAMES.
The USER acknowledges that the process of transmitting their data over the internet involves various public and private networks and servers, and that this transmission is not encrypted, making it susceptible to interception by third parties.
Notwithstanding the above, PIXSIDE GAMES will make every effort to protect the security, confidentiality, and integrity of USERS' data.
PIXSIDE GAMES may disclose the USER's confidential information when requested by order of a competent judicial or administrative authority.
XIV – GENERAL PROVISIONS
The parties declare themselves responsible for all legal and contractual obligations assumed herein, with the authority to receive notifications, summons, and to be aware of the acts and communications resulting from this Agreement.
This agreement, together with the terms, policies, rules, and guidelines published and updated by PIXSIDE GAMES on the website, constitutes the entire agreement between the parties and replaces all previous written or oral agreements.
The parties declare that: (i) they have full civil capacity, (ii) they have been fully informed about the legal, economic, financial, and fiscal aspects of the Instrument, (iii) there is no evidence of unequal negotiating power between them, and (iv) they freely enter into this Agreement based on their respective economic-financial perspectives.
The terms and provisions in this Instrument are independent of each other, so that if any of them is declared invalid or void, all other terms must remain in effect.
Any tolerance or eventual abstention by PIXSIDE GAMES regarding the violation of duties or enforcement of rights under these terms must be interpreted as mere liberality, and shall not be construed as a waiver or novation or alteration of the contract.
These terms will be interpreted and enforced according to the laws of the Federative Republic of Brazil, as applicable to contracts executed entirely within the country.
These terms are binding and will benefit the parties, their respective successors, and assignees. Any assignment of this contract or rights arising therefrom by any party without the written consent of the other will be null and void.
For the resolution of any disputes arising from this contract, the parties elect the court of São Paulo-SP, Brazil, waiving any other jurisdiction, no matter how privileged it may be.
